Terms and Conditions of Thai Asia Shop

1. GENERAL TERMS AND CONDITIONS

The General Terms and Conditions of the Thai Asia Shop online shop are drawn up pursuant to the Consumer Protection Act (ZvPot)

Anyone can buy products sold in the Thai Asia Shop online shop. Both natural persons and legal entities. By logging in to the online shop once, you become a guest of the online shop. If you register, you become a member of the online shop. Purchases can be made by any visitor without the need for prior registration.

The mere offer of the products presented in the online shop does not constitute a binding contract, but merely non-binding browsing of the online shop. When a guest or a customer clicks the »Buy Now« button, a binding purchase contract is automatically concluded. From that moment on, all prices and other terms and conditions are fixed and apply to both the supplier and the buyer.

The Buyer is bound by the General Terms and Conditions which are in force at the moment the Buyer places an online order or makes a purchase. When the Buyer confirms the purchase of a product, he/she simultaneously confirms that he/she is acquainted with the General Terms and Conditions, the protection of personal data and the legal notice.

2. ACCESS TO INFORMATION

Thai Asian Food Store d.o.o. undertakes to provide the following information to each customer:

• company details (company name and registered office, registration and tax number)
• contact details which allow the user to communicate with the company Thai Asian Food Store d.o.o. (e-mail, telephone)
• main product characteristics
• product availability (each product placed in the online shop should be available in a reasonable time)
• the terms of delivery of the product (method, place and time of delivery),
• all prices must be clearly and unambiguously displayed and it must be indicated whether they include taxes and transportation costs
• the method of payment and delivery
• the period of validity of the offer
• the time limit in which the contract can still be terminated and the conditions of such termination (description of the right of withdrawal from contract under Article 43.č. of the Consumer Protection Act (ZvPot). In the event that the consumer, pursuant to Article 43.č. of the Consumer Protection Act (ZvPot), is not entitled to withdraw, he or she shall be expressly informed of this)
• an explanation of the complaints procedure, including full details of the contact person or customer service.

3. PRODUCTS ON OFFER

Due to the very nature of conducting business online, the offer as well as the prices in the Thai Asia Shop online shop (www.thaiasia.si) are subject to frequent changes and updates.

4. PRODUCT PRICE

The prices of all products found in the Thai Asia Shop (www.thaiasia.si) online shop are stated in Euros (€) and already include the statutory value added tax (VAT). All prices in the online shop apply to the products only. Shipping costs are NOT included in the price of the product. All prices in the online shop apply to the products only. Prices are not valid for a pre-set period of time and apply at the time of placement of the order.

The contract of sale between Thai Asian Food Store d.o.o. and the Customer is concluded at the moment the order is confirmed by Thai Asian Food Store d.o.o.. From that moment on, all prices and other conditions are fixed and apply to both the supplier and the buyer.

The contract of sale (the first e-mail sent to confirm the order) is
stored electronically on the Thai Asia Shop online shop server (www.thaiasia.si).

We reserve the right to make changes and errors in the prices, for which we sincerely apologise in advance.

Discounts and other promotions are NOT CUMMULATIVE unless expressly stated otherwise.

5. CHILD PROTECTION

Thai Asia Shop online shop (www.thaiasia.si) DOES NOT accept orders from anyone known or suspected to be a child or a minor. In such cases, Thai Asian Food Store d.o.o. has the right to request written permission from the child’s parents or legal guardians. Also, the online shop DOES NOT allow free access to products which are harmful to children.

Thai Asian Food Store d.o.o. does not accept any personal information that is »linked« to a child or a minor without written permission from their parents or guardians. The personal data obtained from children will only be shared with their parents or legal guardians.

6. ORDERING THE PRODUCT WITH A BINDING CONTRACT OF SALE

The contract of sale between Thai Asian Food Store d.o.o. and the Buyer is
automatically concluded the moment when the Buyer clicks the »Buy Now« button.

Purchase procedure

Thai Asia Shop online shop (www.thaiasia.si) is open to everybody (both natural persons as well as legal entities).

First you select a product you wish to buy. On the right side of your selected product, choose the quantity (how many pieces of the selected product you wish to buy) and then click on the »Add to basket« or »Buy now« button. At the top right of the shopping cart page, you will see the amount to be paid. Then click on the »To the checkout« button. When the checkout screen opens, you will have blank fields where you can enter the necessary information we will need in order to process and complete your order. If you have a discount code and would like to redeem it, enter it in the specially marked box. Then click on the »Redeem voucher« button.

Once you have selected all the products you wish to buy, you will see the total amount to be paid on the right hand side. Then click on the »Buy now« button. You will then be asked to choose the method of your payment and whether the products you have ordered will be delivered by delivery service or whether you will collect them in person.

Before you place your order, it is MANDATORY that you confirm that you have read the terms and conditions and that you agree with them by ticking the checkbox. Zdaj lahko kliknete na gumbek “Kupite sedaj”. You have thus successfully completed your purchase.

Once the order has been placed you will receive a summary of the ordered products to your e-mail address (e-mail). This is final confirmation and completion of your order. To change your order or cancel your order, you can email info@thaiasia.si within 30 minutes of placing your order. If the notification is sent within 30 minutes of placing the order, we will take the change or cancellation into account. We will NOT accept cancellations after this time limit has expired.

The contract between the Buyer and Thai Asian Food Store d.o.o. is also irrevocably concluded at this moment. The order or contract of sale binds the buyer as well as the online shop to fulfil all their obligations. In the event that the Buyer cancels the order, the Buyer shall be liable for all direct costs incurred as the result of the shipment, in accordance with the Consumer Protection Act (Article 43c, paragraph 6).

If the Buyer orders products from the online shop and then does not collect them, the Buyer shall bear the costs of postage both ways. The price of postage is determined by the delivery service. In this case, the Buyer is also NOT entitled to a refund of the purchase price.

The Buyer has the option to view his order in the online shop.

7. DISCOUNT CODE

This special discount code allows you various benefits when you buy from Thai Asia Shop online shop (www.thaiasia.si). You will find the current active code in the email you will receive from the Thai Asia Shop team or through other advertising media. The code is limited in time and offers various discounts. After the expiration of this period, the code is no longer valid.

• You choose the product you want to buy in the Thai Asia Shop online shop (www.thaiasia.si)
• Then go to your shopping basket or shopping cart and on the left hand side
  under the selected products you will see a box where you enter the discount code.
• Then click on the »OK« button.
• Once you have entered the discount code, the amount of discount of the code will be automatically deducted from the price of your selected products. This will leave you with the amount to be paid.
• Only one discount code can be redeemed per each purchase.

8. INVOICING

The Thai Asia Shop online shop (www.thaiasia.si) will send you a PDF invoice to your email address (e-mail) after you have completed your purchase and paid for the products you have ordered. The invoice will also contain a breakdown of the rate of Value Added Tax (VAT) as well as any other costs incurred in connection with the purchase. It is the buyer’s responsibility to verify the accuracy of the information.

9. METHOD OF PAYMENT

The shop owner offers the following payment methods to the buyer:

• pro forma invoice
• payment due upon receipt of the ordered products
• card (Visa, Maestro, Mastercard)

Thai Asian Food Store d.o.o. shall issues an invoice to the buyer for the products paid for with itemised costs. The invoice is in Slovene language and is sent in PDF format to the buyer’s e-mail address.

10. RETURN OF PRODUCT or WITHDRAWAL FROM CONTRACT

IMPORTANT: The withdrawal option set out in this section is only available to natural persons who purchase products for their own use. Legal entities DO NOT have the right to withdraw from the contract. Legal entities include sole proprietors (s.p.) and are subject to the same conditions as other legal entities.

For distance contracts and under the Consumer Protection Act (ZVPot), the buyer has the right to return the goods within 14 days without stating a reason.

The Buyer MUST notify Thai Asia Shop online shop in writing of their intention to return the product to
info@thaiasia.si, no later than 14 days after the receipt of the product.

The Buyer must return the product no later than 14 days from the date of the notification. The product shall be returned to:

The product must be returned in its original packaging, undamaged and unchanged. The product MUST NOT have any visible signs of use. When returning the product, please enclose the original receipt and the details of your transaction account to which we will refund the purchase price.

To return the product, please use a delivery service that allows tracking of shipments. The costs incurred in connection with the return will be borne by the buyer. We DO NOT ACCEPT returns with a payment due upon receipt.

In the event of withdrawal from the contract in which a discount code has also been used, the discount will be taken into account as a discount and will NOT be REFUNDED to the Buyer. Only the amount paid will be refunded to the Buyer’s bank account and the discount code will be returned to the Buyer at the same time. Thai Asia Shop will also inform the customer how long the discount code is valid again.

The refund will be made by Thai Asian Food Store d.o.o. (Thai Asia Shop) within 14 days of receipt of the witdrawal notice.

Thai Asian Food Store d.o.o. (Thai Asia Shop) will only refund the purchase price to the buyer’s personal bank account (TRR). The refund will only be made to the country from which the payment was made and received. In case of transfers to countries outside the SEPA system, additional bank charges will apply.
In the event that the customer provides an incorrect address and/or bank account number, and the refund is returned to Thai Asian Food Store d.o.o. (Thai Asia Shop) due to the incorrect address/ bank account number, the remittance will be charged at the commercial bank’s rate used by Thai Asian Food Store d.o.o. (Thai Asia Shop). Thai Asian Food Store d.o.o. (Thai Asia Shop) also reserves the right to withhold the refund of the purchase price until the returned product has been collected or until the customer has emailed confirmation that the product has been sent back.

Complaints

If you find that the product is not as specified in the contract when it is delivered, you must contact us within 14 days of receiving of the shipment. You can do this by sending a detailed description of the defect to info@thaiasia.si and you must allow the seller to inspect the product. The product complained about must be sent to the following address:

Within 14 days after the notification has been sent, you must send us the product you wish to complain about. The original invoice and the details of your bank account to which we will refund the purchase price MUST be enclosed.

Thai Asian Food Store d.o.o. (Thai Asia Shop) will transfer the purchase price to the buyer’s personal transaction account (TRR) within 14 days of receipt of the notification.

11. DELIVERY

IMPORTANT: In the event that
unforeseen problems related to delivery have occurred between the confirmation of the order and the shipping of the products, Thai Asia Shop shall inform the Buyer of the situation. Thai Asia Shop reserves the right to cancel the order as a last resort. If the order is cancelled and you have already paid the purchase price by credit card, Thai Asian Food Store d.o.o. will refund the purchase price to your bank account (TRR).

After we receive your order, it will be processed by our sales department within 1-5 business days. You will receive a shipment notification to your email address (e-mail) once the shipment has been dispatched.

Products ordered from Thai Asia Shop online shop (www.thaiasia.si) are shipped throughout the Republic of Slovenia and to the Republic of Croatia.
Shipping costs are NOT included in the price of the product and will be charged extra. For shipping products within the Republic of Slovenia the price is 5,50 EUR and for shipping products to the Republic of Croatia the shipping price is 17,00 EUR.

12. DISPUTE RESOLUTION ONLINE

Thai Asia Shop complies with the applicable consumer protection legislation
and makes every effort to fulfil its duty. In doing so, an effective system for handling complaints will be put in place. A person shall be designated as the main person to deal with complaints. The customer may contact this person either by telephone or by e-mail.

A complaint shall be sent to the following e-mail address: info@thaiasia.si The complaint itself is a confidential document and will be treated as such. Within five business days, the person responsible for handling complaints will send an e-mail to the customer’s e-mail address informing them that the complaint has been accepted.
At the same time, the Customer will be informed of the timeframe within which the complaint will be resolved and will be kept informed of the progress of the procedure during the procedure itself.

In case of a dispute where all options for an out-of-court settlement have been exhausted, the competent court shall be the Court of Ljubljana.

Thai Asian Food Store d.o.o., which owns and operates the Thai Asian Shop online shop (www.thaiasia.si), does not, in accordance with the provisions of the applicable legislation, recognise any provider of out-of-court settlement of consumer disputes which the customer could initiate in accordance with the statutory Out-of-Court Settlement of Consumer Disputes Act.

Thai Asian Food Store d.o.o. publishes an internet link to a platform where you can find information for online dispute resolution (SRPS). The platform is available to all customers and can be found at the following address: http://ec.europa.eu/odr.
The regulation is based on the Out-of-Court Settlement of Consumer Disputes Act (Official Journal of the Republic of Slovenia, No 81/15), Regulation (EU) No 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amendments to Regulation (EC) No. 2016/2004 and Directive 2009/22/EC.

These General Terms and Conditions shall enter into force on 15 July 2022
